This website is offered by MOORvision Technologies Inc., a Delaware corporation with its headquarters in Los Angeles, CA in the United States (hereinafter “MOORvision, “we”, “our” and “us”), to the user of this website (hereinafter “you and your(s)”) subject to your acceptance of the terms, conditions, and notices contained in these Terms of Use. These Terms of Use apply to your use of or visit to this website and all functions or features of this website, as well as all offers, sales, purchases, and rentals of products or services sold through this website. By accessing and using this website, you signify your agreement to and acceptance of these Terms of Use, as they may be modified from time to time by MOORvision. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. 

BY USING THIS WEBSITE YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THESE TERMS OF USE AS YOUR BINDING AGREEMENT.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to MOORvision, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without MOORvision’s express prior written consent.

You may use the information on MOORvision products and services, provided that you (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such documents.

ORDER ACCEPTANCE & PAYMENT

MOORvision will only accept orders made through this or a pre-approved co-seller website. MOORvision reserves the right, without prior notification, to accept or decline your order or limit the order quantity for any reason. Where payment is made by credit/debit card, such payment is subject to the approval of the financial institution issuing the credit/debit card, and MOORvision shall not be liable in any way if such financial institution refuses to accept or honor the credit/debit card for any reason. MOORvision may also require additional verification or information before accepting any order. 

SHIPPING AND HANDLING; SALES AND OTHER TAXES

Unless otherwise noted, shipping and handling fees will be charged separately. Sales and similar taxes shall be charged to you by MOORvision, as required by law.

COMPLIANCE WITH RETURNS POLICY

In connection with returns of products purchased or rented at this website, you agree to comply with and be bound by the MOORvision Return Policy, which is incorporated herein by reference and made part of these Terms of Use. MOORvision reserves the right not to process any return that does not comply with our Return Policy.  

REFUNDS & RETURN POLICY

Certain sales of products on this website may be eligible for full or partial refunds. You have 14 calendar days to return an item from the date you received it. Only items that have been purchased directly from MOORvision can be returned to MOORvision. MOORvision products purchased through other retailers must be returned in accordance with their respective returns and refunds policy. Please ensure that the item you’re returning is repackaged with all the cords, adapters, and documentation that were included when you received it.

If you are not completely satisfied with your purchase, you must contact MOORvision via the website Contact Page within 14 days of purchase or receiving the product date, whichever comes later. 

Once we receive your item, a refund is initiated immediately. If you paid by credit or debit card, refunds will be sent to the card-issuing bank within five business days of receipt of the returned item or cancellation request. Please contact the card-issuing bank with questions about when the credit will be posted to your account.

INACCURACIES; TYPOGRAPHICAL ERRORS

We do our best to be accurate. However, we do not warrant that this website’s product descriptions or other content are completely accurate or error-free. If a product offered by MOORvision is not as described, your sole remedy is to return it in accordance with our Return Policy. In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or an error in pricing or product information received from MOORvision suppliers, MOORvision shall have the right to refuse or cancel any orders placed for products listed at the incorrect price whether or not the order has been confirmed and your credit/debit card has been charged. If your credit/debit card has already been charged for the transaction and your order is canceled, MOORvision shall issue a credit to your credit/debit card account for the amount of the charge.

SITE AVAILABILITY AND SECURITY

At any time and from time to time, all or any portion of this website may not be available or may not function properly. MOORvision is not liable for any damage or injury caused by the performance or failure of performance of all or any portion of this website or resulting from your use of this website.

ELECTRONIC COMMUNICATIONS

When you visit this website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically unless you opt-out of receiving such communications. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, or other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Los Angeles County, California, and waive any objection to such jurisdiction or venue. The preceding provision regarding venue does not apply if you are a consumer based in the European Union. If you are a consumer based in the European Union, you may make a claim in the courts of the country where you reside. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. Claims made under the separate terms and conditions of purchase for goods and services are not subject to this limitation. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between MOORvision and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

INTERNATIONAL USERS

We control this website from our offices within the United States. We make no representation that the content on this website is appropriate or that access to such content is lawful in all jurisdictions. Those who access this website from outside of the United States are responsible for compliance with applicable laws in the jurisdictions from which this site is accessed. By visiting this website, you acknowledge and agree that we may use any data collected in the course of our relationship for the purposes identified in the Privacy Policy or in our other communications with you, including the transmission of information outside your resident jurisdiction. FORCE MAJEURE

MOORvision shall not be liable for any failure to perform any of its obligations under these Terms of Use if its performance of such obligations is substantially hindered due, directly or indirectly, to any circumstance beyond the reasonable control of MOORvision, including, but not limited to, war, riot, fire, flood, explosion, storm, accident, civil unrest, strike, lockout, trade dispute, labor disturbance, failure of any machine, system of authorization, data processing or communication system or transmission link, act of any governmental agent, department or other entity or act of God. In such an event, MOORvision may elect to cancel your order and refund any payments made.

Information that’s shared publicly 

When you create an account, we create a basic profile page for you on our platform, containing your name, username, and the date the account was created. By default, your profile is public and you can choose to make it private in your account settings. Your username or your name appears with the comments you post and messages you send on MOORvision and, if your profile is set to public, people can click your username to view it. 

Information that isn’t shared publicly

The following data will not be publicly displayed or revealed to other users:

    • Any payment information you provide;
    • Your password details;
    • Your IP address;
    • Your identity verification documentation;
    • Private profile information, in accordance with your preferences; and
    • Communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem);

Links to other websites and services

Our Site may include links to other websites or services whose privacy practices may differ from ours. When you use a link to an external site or service, the privacy policy, and data processing disclosures for that site or service govern.

Retention

We will retain your information as long as your account is active, as necessary to provide you with the Services, or as otherwise set forth in this Policy. We will also retain and use this information as necessary for the purposes set out in this Policy and to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements and protect MOORvision’s legal rights.

We also collect and maintain aggregated, anonymized or pseudonymized information which we may retain indefinitely to protect the safety and security of our Site, improve our Services or comply with legal obligations.

Data Transfers

Because MOORvision Technologies is a US-based company, your information will be collected and processed in the United States. The United States has its own laws governing data protection and government access to information. The rules that protect your personal information under United States law may be different than in your home country. If you choose to use the Services, you need to agree to our Terms of Use, which set out the contract between MOORvision and its users. 

Whenever in the course of sharing information we transfer personal information to countries outside of the United States and other regions with comprehensive data protection laws, we will ensure that the information is transferred in accordance with this Privacy Statement and as permitted by the applicable laws on data protection.

Shine the Light 

The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Our website uses cookies to help us identify and track visitors, their usage of our website, and their website access preferences. General Data Protection Regulation (GDPR) Compliance

Personal data you provide on any of our websites is only collected with your consent and may be transmitted outside of the EEA to us (or computer servers maintained for the benefit of our platform) pursuant to that consent. In general, under the GDPR you may:

  • have incomplete or incorrect data corrected
  • have your personal data deleted
  • suspend or restrict our use of your personal data, or withdraw your consent
  • request a copy of your personal data
  • complain to a supervisory authority if you believe your rights under the GDPR are not being respected

We will supply you with a copy of your personal data if you request it.
